What is a Power of Attorney?

It is often wise to consult a qualified attorney in situations such as:

  • When granting broad financial powers that could expose you to risk if misused.
  • If your case involves complex property transactions or cross-border dealings.

  • If you are concerned about POPIA compliance when dealing with sensitive personal data.

Example Case

Consider the example of Mr Naidoo, who needed to sell his Johannesburg property while relocating overseas. By drafting a Power of Attorney appointing his brother to act on his behalf, he was able to complete the sale without returning to South Africa. 

However, because the sale involved a mortgage settlement, the bank required a properly drafted Power of Attorney reviewed by an attorney. 

Without this legal input, the process could have been delayed or even challenged.
